Clay Course Release Forms

THIS IS A VERY IMPORTANT DOCUMENT. YOU MUST READ IT BEFORE SIGNING. THIS DOCUMENT CONTAINS A RELEASE OF CLAIMS. IF YOU SIGN IT YOU WILL BE RELEASING THE RELEASORS FROM ALL CLAIMS YOU MAY HAVE.

In consideration of being permitted to participate in the shooting clay course or other shoots, hunts, etc… which may or may not include any instruction (the “Event”), which involves the use of firearms by Releasor and others, held at Ashbourne Farms in Oldham County, Kentucky, and organized by Ashbourne Farms (the “Organizer”), the undersigned Releasor executes this Release Agreement.

The undersigned, for himself/herself and his/her spouse, legal representatives, heirs and assigns, hereby releases, waives and discharges the Organizer, Ashbourne Enterprises LLC and Ashbourne Farms II LLC, Harrods Creek Sporting Club LLC (HCSC) and their respective officers, managers, members, representatives, agents, and employees and subsidiaries (herein collectively the “Releasees”), from any and all liability of any nature whatsoever to the Releasor, including, but not limited to for any and all loss or damage, and any claim or damages resulting therefrom, on account of injury to Releasor’s person or property, even injury resulting in the death of the Releasor and while the Releasor is participating in the Event and is on the premises where the shooting clay course is being held, whether caused by the negligence, omission, or act of the Releasees, a third party, or otherwise.

Releasor agrees to indemnify the Releasees and each of them from any loss, liability, damage or cost they may incur due to the participation of Releasor in the Event and while Releasor is on the premises where the Event is being held.

The undersigned understands and acknowledges that participation in the Event involves a dangerous activity, and as a participant, the Releasor may suffer serious bodily, psychological, or physical injury or death, or cause injury or death to another’s property or person. Releasor hereby assumes full responsibility for any and all risks associated with the Event, known and unknown, including without limitation the risk of bodily injury, death, or property damage due to the negligence, omission, or act of Releasees or otherwise while participating in the Event and while on the premises where the Event is held.

Releasor expressly agrees that this release, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Kentucky.

The undersigned acknowledges that he/she is at least eighteen (18) years old, has read this document and fully understands its contents. The undersigned is aware that this is a release of liability and signs it of his/her own free will.
